"Rerouting constraint" (foresight test 3)
This test belongs to the thought experiment about US intent: it states in advance what each reading expects, so the result can count for or against any of them, including the foresight reading.

Open-ended; review at A+120 days and A+12 months (A = the later Royal Assent of Bill C-39 and of the bill containing the Mega Deduction), and whenever a tidewater (coastal export) project reaches a final investment decision or stalls - Status
- Open: The window has not closed; nothing has settled it yet.
What counts
What counts: actions and formal documents only, from a primary source or two independent reports: deal or treaty clauses restricting Canadian resource sales to third countries (first-refusal, offtake or "tariff-free partners only" terms); US measures or formal pressure on named overseas buyers of Canadian crude, LNG, uranium, potash or critical minerals; US action against the tidewater projects (the West Coast pipeline, Ksi Lisims, LNG Canada Phase 2, Roberts Bank Terminal 2). Threats not carried out are logged as statements, not scored. For each item, we record whether it came before or after the rerouting capacity was visible (a final investment decision or shippers signed counts as visible).
What each result means: a constraint that appears after visibility, aimed at rerouting while the southbound build-out is left alone, is reactive leverage recovery and counts for the plain self-interest reading. A constraint built into early deal terms, before visibility, fits the foresight reading with planned recapture, and counts at most slightly for the foresight reading. No constraint while rerouting capacity grows through A + 12 months counts slightly for the foresight reading (tolerating lost leverage for volume and security fits wanting the build-out).
With the "Pressure returns if the build-out stalls" test: US welcome of a tidewater stall favours the plain self-interest reading; US pressure against a tidewater stall favours the foresight reading. For southbound projects, that test's reading stands.
What each reading expects
| Reading | Expects | If seen |
|---|---|---|
| I0b Plain self-interest; Canada's response not considered Tested hypothesis (intent) | Constraint on rerouting capacity appears after it becomes visible, southbound build-out left alone | Counts for it |
| I2 Foreseen and wanted (this level or higher) Tested hypothesis (intent) | No constraint while rerouting capacity grows through A+12 months (a constraint built into early deal terms counts at most slightly for this reading) | Counts for it |
Observations
- US Department of Defense awards US$15M under Defense Production Act Title III to Northcliff Resources (Sisson tungsten-molybdenum project, New Brunswick); NRCan adds up to C$8.2M
None of the 7 US Defense Department grants to Canada-located projects (2023-06 to 2025-05, ~US$82M) carries a disclosed offtake or US-priority clause; US-priority language appears only in deals over US assets (Elmet deliveries to the National Defense Stockpile) and in the reported trade-talk ask. No constraint through funding terms observed. Confidence: medium.
- TerraMarine team named preferred proponent for the Roberts Bank Terminal 2 landmass and wharf
Rerouting capacity not yet 'visible' under this test's rule (no tidewater final investment decision or signed shippers): Roberts Bank Terminal 2 preferred proponent named, LNG Canada Phase 2 and Ksi Lisims decisions targeted for end-2026, West Coast pipeline listing due ~2026-10-01. No constraining US action found in the journal's research. Confidence: medium.
- Reported US ask in the August 2026 trade talks: a right of first refusal on Canadian critical minerals Caution: anonymous sources
Reported US ask for a right of first refusal on Canadian critical minerals (first reported by the Globe, unnamed sources; relayed by Platts and others). Terms never published on record. Under this test's rule (actions or formal documents from a primary source or two independent reports) it is logged as a statement, not scored. Follows the Ukraine 2025-04-30 template ('a right similar to a right of first refusal'); 'capped prices' is unsubstantiated. Confidence: medium.
- US seeks an updated critical-minerals agreement with Canada; Ottawa rules out 'exclusive access'
US seeks an 'updated pact' on critical minerals (Hill Times, paywalled); terms unverified; Ottawa won't negotiate away 'exclusive access'. Logged, not scored (terms unknown). Confidence: medium.
- LNG Canada's partners take the final investment decision on Phase 2, to double the Kitimat plant's capacity to 28 million tonnes a year
With LNG Canada Phase 2's final investment decision (29 September 2026, +14 Mtpa), rerouting capacity becomes visible under this test's rule; no constraining US action found as of 1 October 2026.
- US Defense Department obligates the second US$10M of its US$20M Defense Production Act award to Electra's Ontario cobalt refinery
The Pentagon's second US$10 million for Electra's Ontario cobalt refinery, under a 2024 Defense Production Act award. No clause restricting sales to other countries disclosed: logged, does not count. Confidence: medium.
- Washington Governor Ferguson and the state Ecology director criticize Canada's Pacific Link listing over Salish Sea tanker traffic
Washington State's governor criticizes the Pacific Link listing over tanker traffic. A state government's statement, not a federal measure against a coast export project: logged, does not count. Confidence: high.
