York1 withdraws its court challenge against Chatham-Kent over the Dresden waste site that Ontario's Bill 5 exempted from environmental assessment
The York1 industrial landfill and waste-processing project at Dresden, Ontario (an 8 ha landfill cell; processing site to expand from 0.8 ha to 25 ha) was exempted from environmental assessment requirements by Ontario's Bill 5, effective June 5, 2025 (Environmental Registry of Ontario 025-0389). On 24 September 2026 York1 withdrew its court application arguing that the Municipality of Chatham-Kent's zoning rules did not apply; it said it would seek a zoning by-law amendment through the regular municipal process (CBC News).

Claims that rest on this event
- A law passed is not a power switched on. BC's narrow Bill 14 was in force in 33 days and is being used for the North Coast Transmission Line, but only 1 of Bill 15's 48 sections was in force in late September 2026, 16 months after it passed, Quebec's Bill 5 lapsed, and Ontario has not yet designated any special economic zone. So the test of whether the build-out is locked in must ask whether powers are brought into force and used.
York1 withdrew its court challenge over the Dresden waste site, which Ontario's Bill 5 had exempted from environmental assessment: one place where a power in Bill 5 has been used.
