Alberta Energy Regulator approves Prosper Petroleum's Rigel oil sands project near Fort McKay's Moose Lake reserves
The AER approved the Rigel in-situ project (2018 ABAER 005) inside the area of the Moose Lake Access Management Plan, which Alberta and Fort McKay First Nation had been negotiating since 2003 to address cumulative effects on the Nation's Treaty 8 rights; the plan was not yet in place. Fort McKay, which had objected, appealed the decision to the Alberta Court of Appeal (2020 ABCA 163, para. 1).
